Finding land for sprawling solar trough farms, such as the one seen below, is often less difficult than securing routes for the transmission lines to carry the electricity from the generation site to the population centers that need it. Marin County Supervisors voted narrowly last month to create the Marin Energy Authority, a new and hotly debated distribution entity.
But now, only six weeks later, the Office of Environmental Health Hazard Assessment OEHHAthe Proposition 65 lead agency and promulgater of the enabling regulations, is seeking to effectively reverse this ruling and exempt acrylamide in coffee from the need for a warning.
CERT eventually added more than forty-five additional defendants, including coffee shops, coffee wholesalers, supermarkets, and others, contending that they all are required to provide warnings. After years of pre-trial proceedings and in decisions issued after two lengthy bench trials, Judge Berle ruled against the defendants on their key defenses.
When the ruling becomes final after objections and arguments from counselthe court will conduct one or two more trials to determine what penalties should be awarded to CERT and the State of California against the defendants, and what injunctive relief should be ordered with respect to warnings that must be provided in the future.
And the impact of this across the board could be enormous: Sellers and providers of coffee across the state, whether sellers of beans, coffee shops, grocery stores or even businesses who give free coffee to their customers, could face Proposition 65 enforcement actions if they also fail to provide warnings.

They have not improved with the revisions, but the text of one of the notices has changed. The regulations provide that safe harbor warnings for furniture must include both a warning on the product, its package or its labeling and a notice on either a sign in the store or the printed receipt.
Considering that primary Proposition 65 warning responsibility is supposed to lie with manufacturers, importers, distributors and the like and not with retailers, it is certainly puzzling how the non-retailers in the stream of commerce can ensure compliance.
Under the revisions to section Please check the on-product label for warning information. Now, these have been modified somewhat, limiting the special diesel regulations to diesel engines other than in passenger vehicles, pickup trucks and vans.
As revised, sections Such notice must be printed in no smaller than point type, be enclosed in a box and appear inside or outside the front or back cover of the manual or on the first page of the text, and A The warning is provided on a label permanently attached to the product in a location that is easily visible to the operator of the vehicle, engine, or other equipment when it is being operated, or B If other warnings or operating instructions are provided in an on-screen display, the warning is provided in that manner, using the same type size as other operator warnings.
In no case shall the warning appear in a type size smaller than 8-point. Always start and operate the engine in a well-ventilated area.
If in an enclosed area, vent the exhaust to the outside. Do not modify or tamper with the exhaust system. Do not idle the engine except as necessary.
